PROCEDURES AND CODE OF CONDUCT
1. ALL STUDENTS MUST GO THROUGH THE BREAKFAST LINE AND PICK 3 ITEMS. IF YOU CHOOSE NOT TO EAT YOU MUST GO TO THE GYM.
2. YOU CANNOT LEAVE SCHOOL GROUNDS ONCE YOU GET HERE.
3. ONCE YOU EAT - GO TO GYM – go to the bathroom AFTER breakfast – you cannot leave the gym once you get in.
4. NO ONE IS ALLOWED IN THE LOCKER ROOMS IN THE MORNING – ALL ATHLETES MAY PUT THEIR STUFF IN THE STORAGE CLOSET NEXT TO GYM.
5. CAFETERIA RULES - - STAY SEATED AT ALL TIMES UNLESS YOU’RE DUMPING TRAY, NO FOOD OUTSIDE CAFETERIA, CLEAN UP AFTER YOURSELF
**LEAVING THE CAFETERIA DIRTY WILL RESULT IN LOSS OF PHONE PRIVILEGES FOR THAT GRADE LEVEL THE NEXT DAY**
6. INTRAMURALS – STUDENTS MUST STAY SEATED IN GYM
7. LOCKER ROOM RULES – ONLY STUDENTS WHO ARE DRESSING ARE ALLOWED IN LOCKER ROOMS – YOU MAY BRING YOUR OWN LOCK FOR YOUR STUFF.
8. BATHROOM RULES – KEEP IT CLEAN – CONSEQUENCES WILL BE HARSH FOR TRASHING THE BATHROOM
9. ATHLETICS – IF YOU’RE IN ALC OR SUSPENDED, YOU CAN’T PRACTICE – IF YOU’RE SUSPENDED, YOU CAN’T BE ON ANY KCS SCHOOL UNTIL SUSPENSION IS OVER – ALC KIDS CAN PLAY IN GAMES
10. YOU CAN’T STAY AFTERSCHOOL AND HANG OUT TO WATCH A LATE GAME – IF YOU GO TO A NIGHT GAME, MAKE SURE SOMEONE IS PICKING YOU UP ON TIME
11. ATHLETES - AFTER PRACTICES – GO HOME – IF A PARENT CAN’T PICK YOU UP, YOU CAN’T PLAY THAT SPORT
12. HAZING IN SPORTS - BULLYING, HARASSMENT, INTIMIDATION WILL NOT BE TOLERATED

*D-HALL IS A 30 MINUTE “QUIET LUNCH” IN THE CAFETERIA. WHILE IN D-HALL, STUDENTS WILL WRITE ESSAYS. D-HALL IS AN INTERNAL SCHOOL CONSEQUENCE. PARENTS WILL NOT BE NOTIFIED OF D-HALL. IT IS THE STUDENT’S RESPONSIBILITY TO INFORM PARENTS OF ALL D-HALL OFFENSES.
*ALC IS AN ALL DAY PLACEMENT WITH A TEACHER. STUDENTS WILL BE GIVEN SCHOOL WORK AND AN ALC PACKET.
*ANY THREATS, BULLYING, OR HARASSING BEHAVIOR THAT DIRECTLY AFFECTS STUDENTS AT HAYES MIDDLE SCHOOL BECAUSE OF FACEBOOK, SNAPCHAT, TWITTER, TEXTING, ETC. WILL FACE DISCIPLINARY ACTIONS
*ANY RULE VIOLATIONS ON THE WAY TO SCHOOL OR GOING HOME IS CONSIDERED A SCHOOL MATTER AND WILL FACE DISCIPLINARY ACTION.

ALC
THE ALTERNATE LEARNING CENTER (ALC) REINFORCES POSITIVE BEHAVIOR WITH DIRECT SUPERVISION AND SUPPLEMENTAL ASSIGNMENTS. EACH STUDENT WILL BE ASSIGNED AN ALC TEACHER THAT WILL SUPERVISE EACH DAY OF ALC. AN ALC PLACEMENT WILL FOCUS ON EFFORT, RULE COMPLIANCE, AND BASIC SKILL ACQUISITION. ALC STUDENTS STAY IN ONE CLASS SO DISTRACTIONS ARE MINIMIZED AND WORK IS COMPLETED. ANY CHILD IN ALC WILL NOT BE ABLE TO PARTICIPATE IN EXTRA CURRICULAR ACTIVITIES ON THE DAY OF THEIR ASSIGNED ALC.
ALC RULES

3. YOU MUST BE WORKING THROUGHOUT THE DAY (ALC TEACHER WILL ASSIGN BREAKS AND/OR BATHROOM).

5. YOU MUST COMPLETE ASSIGNED CLASSWORK FIRST AND IF YOU HAVE TIME, THE ALC PACKAGE INCLUDING THE ESSAYS.
6. ALC STUDENTS REPORT TO LUNCH D-HALL
7. THE ALC PACKET TAKES THE AVERAGE STUDENT ABOUT 3-4 HOURS TO COMPLETE. THIS ALONG WITH YOUR CLASSWORK SHOULD OCCUPY YOUR WORK DAY WITHOUT INTERRUPTION.

SOCIAL MEDIA POLICY
Cyberbullying by a Hayes Middle School student directed toward another Hayes student or school staff member is conduct that disrupts both a pupil’s ability to learn and a school’s ability to educate its pupils in a safe environment. Hayes Middle School prohibits acts of cyberbullying by its students through the use of any Kanawha County owned, operated, and supervised technologies. Any act online, the Internet or through electronic devices (cellular phones, tablets) that deliberately threatens, harasses, intimidates an individual or group of individuals; places an individual in reasonable fear of harm to the individual or damage to the individual’s property; has the effect of substantially disrupting the orderly operation of the school is considered cyberbullying. Any student or school staff member that believes he/she has or is being subjected to cyberbullying, as well as any person who has reason to believe a student or school staff member has knowledge or reason to believe another pupil or school staff member is being subjected to or has been subjected to cyberbullying shall immediately make a report to the school principal or designee.
KCS DRUG POLICY
A student will not unlawfully possess, use, be under the influence of, distribute or sell any substance containing alcohol, over-the-counter drugs, prescription drugs, marijuana, narcotics, any other substance included in the Uniform Controlled Substances Act as described in West Virginia Code §60A-1-101, et seq. or any paraphernalia intended for the manufacture, sale and/or use of illegal substances in any building/area under the control of Kanawha County Schools, including all activities or events sponsored by Kanawha County Schools.
1st Offense for use, possession or being under influence – Confiscation of the substances, drug devices or alcohol; Suspension (10 days Mandatory); Completion of drug program approved by KCS KANAWHA COUNTY BOARD OF EDUCATION (Mandatory); Criminal charges filed; Drug counseling by school psychologist
2nd Offense for use, possession or being under influence or 1st Offense for distribution – Confiscation of the substances, drug devices or alcohol; Suspension (10 days Mandatory); Criminal charges filed; Recommended transfer to an alternative school for placement for remainder of current semester and the next succeeding semester; a petition for reinstatement to the home school may be made to the Superintendent after the student has attended at least eighteen (18) weeks in the alternative school. Petitioning does not guarantee an early return.
3rd and subsequent Offense for use, possession or being under the influence or 2nd and subsequent offense for distribution – Expulsion and filing criminal charges. (Mandatory)
TOBACCO POLICY – Possession/Use of Tobacco and/or Nicotine.
A student will not unlawfully possess, use or be under the influence of any substance containing tobacco and/or nicotine or any paraphernalia intended for the manufacture, sale and/or use of tobacco/nicotine products in any building/area under the control of Kanawha County Schools, including all activities or events sponsored by Kanawha County Schools.
1st Offense – Confiscation of tobacco products (includes smokeless and smoking paraphernalia); Mandatory contact with parent/guardian; mandatory attendance at smoking education class provided by the school nurse.
2nd Offense – Confiscation of tobacco products and smoking paraphernalia; 3 days out of school suspension, if possession or actual use of tobacco products has been determined; mandatory conference with the parent/guardian.
3rd Offense – Confiscation of tobacco products and smoking paraphernalia; up to 5 days out of school suspension or referral to Alternative Learning Center. Police report filed pursuant to W. Va. Code §16-9A-3.
4th and subsequent Offense – Confiscation of tobacco products and smoking paraphernalia; up to 10 days Out-of-School suspension, referral to alternative learning center, if available. Police report filed pursuant to W. Va. Code §16-9A-3.
Possession of a firearm or deadly weapon.
A student will not possess a firearm or deadly weapon as defined in W.Va. Code §61-7-2, on any school bus as defined in W.Va. Code §17A-1-1, or in or on any public or private primary or secondary education building, structure, facility or grounds thereof, including any vocational education building, structure, facility or grounds thereof, or at any school sponsored function as defined in W.Va. Code §61-7-11a. a "deadly weapon" means any device intended to cause injury or bodily harm, any device used in a threatening manner that could cause injury or bodily harm, or any device that is primarily used for self-protection. Deadly weapons include, but are not limited to, blackjack, gravity knife, knife, switchblade knife, nunchuka, metallic or false knuckles, pistol, or revolver. The term deadly weapon also includes explosive, chemical, biological or radiological materials. A deadly weapon may also include the use of a legitimate tool, instrument, or equipment as a weapon including, but not limited to, pens, pencils, compasses, or combs, with the intent to harm another.
For purposes of this policy deadly weapon also includes any instrument which is designed to be used to produce serious bodily injury or death, or is readily adaptable to such use. Examples of such weapons include, but are not limited to blank pistol, signal pistol, starter pistol, stun-gun or other device designed to produce an electrical shock, pellet gun, or BB gun; any razor (e.g., straight, regular, retractable, etc.); any defensive device (e.g., gas repellent, mace, stun-gun chemical sprays, etc.); chains, club, nightstick, rings, pipe, studded or pointed bracelets, ax handles, bullets, ammunition of any type, fireworks of any type and size, smoke bomb, stink bomb, or any type of homemade bomb.
If a student is in possession of a deadly weapon pursuant to W.Va. Code §18A-5-1a, the principal shall, within twenty-four hours, request that the Superintendent recommend that the student be expelled.
*IF A STUDENT VOLUNTARILY GIVES STAFF INAPPROPRIATE ITEMS (TOBACCO, WEAPONS, SNUFF, E-CIGARETTES, DRUGS OR DRUG PARAPHERNALIA, ALCOHOL, ETC.) AND BEFORE STAFF FINDS OUT, NO CONSEQUENCES WILL OCCUR.
